FRANCE - ENQUETE JUDICIAIRE - AFFAIRE DU MARCHÉ COUVERT - LE PUY-EN-VELAY
Alors que l'enquête judiciaire du Parquet national financier se poursuit, la rapporteure publique du tribunal administratif de Clermont-Ferrand vient de demander l'annulation du contrat de concession des halles du Marché couvert du Puy-en-Velay. La rapporteure publique a conclu que certains éléments laissent apparaître que le classement des offres ne reposait pas sur des éléments suffisamment objectifs et devaient donc déboucher sur une annulation du contrat de concession avec effet différé à douze mois, accompagnée du versement à Alexis Haon de 10.000 € au titre du préjudice moral. Le tribunal administratif rendra son jugement d'ici à quinze jours. Si l'annulation est validée, une nouvelle consultation devra être lancée pour la gestion de la halle. Les Halles ponotes ont ouvert en février 2023, après un peu plus de deux ans de travaux.
Le tribunal administratif ne s'est pas prononcé sur les possibles responsabilités de la municipalité, d'agents, etc., dans ce dossier. Cela relèvera de l'enquête du Parquet national financier qui se poursuit, après avoir déjà donné lieu à des descentes de gendarmes et des gardes à vue. En plus d'avoir déposé un recours auprès du tribunal administratif, Alexis Haon a porté plainte contre X pour délit de favoritisme en février 2022.
FRANCE - CRIMINAL INVESTIGATION - COVERED MARKET CASE - LE PUY-EN-VELAY
As the judicial investigation by the Parquet national financier continues, the public rapporteur of the Clermont-Ferrand administrative court has called for the cancellation of the concession contract for the halles du Marché couvert in Le Puy-en-Velay. The public rapporteur has concluded that certain elements show that the ranking of bids was not based on sufficiently objective elements, and should therefore lead to the cancellation of the concession contract with deferred effect to twelve months, accompanied by payment to Alexis Haon of €10,000 for moral prejudice. The administrative court will issue its ruling within the next fortnight. If the annulment is upheld, a new consultation process will have to be launched for the management of the hall. Les Halles ponotes opened in February 2023, after just over two years of construction.
The administrative court did not rule on the possible responsibilities of the municipality, agents, etc., in this matter. This will be the subject of an ongoing investigation by the French National Financial Prosecutor's Office (Parquet national financier), which has already led to police raids and arrests. In addition to lodging an appeal with the administrative court, Alexis Haon filed a complaint against X for offence of favoritism in February 2022.
