NOUVELLE-CALÉDONIE : ELECTION DU PRÉSIDENT DU CONGRÈS
Le Congrès de la Nouvelle-Calédonie est l?assemblée délibérante de la Nouvelle-Calédonie, dont le fonctionnement et les attributions sont définis par le chapitre Ier du Titre III (portant sur les Institutions de la Nouvelle-Calédonie) de la loi organique n° 99-209 du 19 mars 1999 relative à la Nouvelle-Calédonie, née de l?accord de Nouméa de 1998.
Le président du congrès est élu chaque année, au cours de la première séance de la session administrative, parmi les membres du congrès.
Les fonctions de président du congrès sont incompatibles avec celles de président d?une assemblée de province. Il ouvre et clôt les sessions. Il fixe l?ordre du jour des séances après avis du bureau et convoque les membres du congrès. En cas de session extraordinaire, l?ordre du jour est fixé par l?autorité qui a demandé sa réunion. En outre, il préside les séances du congrès et exerce la police dans l?enceinte de l?hémicycle. Il peut en expulser toute personne qui trouble l?ordre. Par ailleurs, le président du congrès dirige les services administratifs et nomme aux emplois du congrès. Il nomme également les collaborateurs politiques, nécessaires au fonctionnement des groupes d?élus au sein du congrès. Il est ordonnateur des dépenses d?investissement et de fonctionnement du congrès, tant en ce qui concerne les services administratifs que les groupes d?élus. Enfin, le président du congrès intente les actions et défend devant les juridictions au nom du congrès. À ce titre, il est seul compétent pour défendre les actes du congrès et plus particulièrement les délibérations.
NEW CALEDONIA : ELECTION OF THE CONGRESS PRESIDENT
The Congress of New Caledonia is the deliberative assembly of New Caledonia, whose functioning and powers are defined by Chapter I of Title III (on the Institutions of New Caledonia) of Organic Law No. 99-209 of March 19, 1999 on New Caledonia, resulting from the Nouméa Accord of 1998.
The President of the Congress is elected each year, during the first session of the Administrative Session, from among the members of the Congress. The functions of the President of the Congress are incompatible with those of the President of a provincial assembly. He opens and closes the sessions. He sets the agenda of the sessions after consultation with the Bureau and convenes the members of the Congress. In the case of an extraordinary session, the agenda is set by the authority that requested the meeting. In addition, he presides over the sessions of the Congress and exercises the police in the chamber. He may expel any person who disturbs the order. In addition, the President of the Congress directs the administrative services and appoints to the posts of the Congress. He also appoints the political collaborators necessary for the functioning of the elected groups within the Congress. He is the authorizer of the capital and operating expenses of the Congress, both for the administrative services and for the groups of elected representatives. Finally, the President of the Congress brings actions and defends before the courts on behalf of the Congress. As such, he is the only one competent to defend the acts of the Congress and more particularly the deliberations.
